CONDITIONS OF HIRE

1. These conditions shall apply to all contracts for the supply of the service to the exclusion of all other terms and conditions. We reserve the right to add to, alter or amend or withdrawal any of these terms or conditions without notice.

2. No variation of these conditions shall be binding unless agreed in writing.

3. The price for the provision of the service is inclusive of VAT, which shall be payable in advance of the service.

4. Customers requesting or ordering vehicles which are delivering or collecting containers to leave on the public highway shall reimburse us in respect of any losses, costs, claims, damages or expenses we may thereby sustain, whether of a result of damage to the vehicles, to the containers themselves or to their property of customers or third parties.

5. The customer agrees in all cases to provide and maintain all necessary approach roads and sites for the purpose of delivery, to rely on their own skill and judgement as to the suitability of all approach roads, tracks or grounds, for the purpose of delivery, siting and collection of equipment and to notify us at the time of ordering the service of any special requirements as to delivery.

6. Customers shall provide adequate warning lights on containers that are left on the public highway or in any place they are likely to cause damage or injury to third parties during the hours of darkness and they shall also ensure that level and safe loading (and in particular the even distribution of weight) of materials into the containers. Customers shall ensure that containers are not over loaded, either by volume or by weight. This condition shall endure until the container is collected from the site.

7. The customers warrants as a term of this contract that he/she has lawfully obtained from the appropriate authorities every necessary permission or license that may be required in connection with the use of containers supplied under this contract and indemnifies Bywaters (Leyton) Limited for any loss or damage etc. suffered by the failure of the customers to comply with the warranty.

8. The customer shall allow the equipment (of all types) to be safely placed and operated and shall ensure that the collection vehicles have free access to the equipment. If there is not free access to the equipment, the customer shall incur an additional travel to site charge.

9. The time allowed for delivery and collection of equipment is 10 minutes. If the vehicle is kept waiting longer than this initial time, the customer shall be liable for an additional charge for waiting time.

10. Where possible, services will be arranged to suit the customers. If the scheduled collection is not made, the customer should advise us and we will arrange for the collection to be carried out as soon as practicable.

11. Customers shall reimburse us in respect of any loss of or damage to the equipment while on hire to them, for whatever cause the same may arise (excepting fair wear and tear). They shall also fully indemnify us in respect of any claims for injury or damage caused to person or to property arising from the use of the equipment, howsoever the same may be caused or arise.


12. The customer shall at all times maintain adequate insurance cover for the value of any containers while they are located on the customer's site and shall provide proof of such insurance to Bywaters (Leyton) Limited if requested to do so. In the event of damage to or loss of a container, the customer shall indemnify Bywaters (Leyton) Limited for any such damage or loss.


13. The waste producer warrants that the waste to be collected conforms in all respects to the waste description given when placing the order. The waste producer will notify Bywaters (Leyton) Limited in advance of any collections of any significant change to the composition of the waste to be collected.


14. At no time shall the customer move the equipment without the consent of Bywaters (Leyton) Ltd and where necessary the highway authority.

15. At no time shall the customer part with possession or control of any containers other than to an authorised representatives, employee or officer of Bywaters (Leyton) Limited.

16. The Waste producer is aware of the provisions of the Environmental Protection Act 1990 and the Landfill (England and Wales) Regulations 2002 and any amendments with respect to the correct procedures for the transfer and disposals of controlled wastes. Due regard must be given by the waste producer to the Control of Substances Hazardous to Health Regulations 2002 and to the Animal By-Products Regulations 2003.

17. It is the policy of Bywaters (Leyton) Limited to issue tickets (Waste Transfer Notes) for all collections and customer's signature will normally be obtained, provided it is readily available. If a signature is not obtained, the customer authorises the carrier to sign on its behalf and will accept the record kept by the carrier as being adequate proof of the service.

18. It is the responsibility of the customer to keep a copy of this ticket (Waste Transfer Note). Any copies required at a later date will be subject to an administration charge
